Rules & Regulations
These Rules and Regulations are final on all matters relating to the 2016 Up Here Photo Contest (the “Contest”). By submitting a photo or photos, all entrants agree to be bound by these Rules and Regulations.
Sponsor and Prize Provider
The Sponsor of Up Here Magazine’s 2016 Photo Contest is Up Here Publishing, and the Prize Provider of the Contest is Nikon Canada Inc.
To be eligible to enter the Contest or win a prize, you must be a resident of Canada and not an employee of, a member of the immediate family of, or domiciled with an employee of Up Here Publishing or their subsidiaries, affiliates, and agencies.
Entrants must be 18 years of age or over at the time of photo submission(s). If entrant is under the age of 18, they must be able to present to Up Here Publishing written permission from their primary parent or guardian.
No purchase is necessary to enter the Contest or to win a prize.
All photographs entered in the Contest must be of Northern Canadian content (i.e. taken in the Yukon, Northwest Territories or Nunavut, Nunavik in northern Quebec or northern Labrador).
Participation in the Contest constitutes Entrants’ full and unconditional agreement to abide by these Contest Rules and Regulations and the Prize Provider’s decisions, which are final and binding in all matters related to the Contest.
Contest is open to Canadian residents only. Contest void where prohibited by law.
Personal information collected from Entrants by Up Here Publishing will be used by Up Here Publishing and Nikon Canada Inc., and their affiliates to administer the Contest and in connection with the publication of winning photographs.
Nikon Canada Inc., nor their affiliates will share personal information relating to Entrants with any third parties, except as necessary for the administration of the Contest or as may be required by law.
Nikon Canada Inc. will not attempt to contact the Entrant for any other purpose than to administer the Contest or as may be required by law unless they have opted in to receive relevant communications from the Prize Provider. The Prize Provider respects the privacy of everyone who enters the Contest.
Format of Photographs for Submission
Entrants must be able to provide a high-resolution version of each photo that they submit (uncompressed TIFF or maximum quality JPEG, Grayscale or Colour (RGB), minimum 1600 pixels on the longest side).
For photographs selected as a winning entry, a high-resolution version of the photograph will be required for reproduction in Up Here magazine.
Entrants who fail to provide a high-resolution version to Up Here magazine within the time period set by the Prize Provider (not to exceed one week following prize notification) will forfeit the prize and an alternate winner will be selected by the judging panel. In such a case, no substitute, cash or alternate prize(s) will be awarded.

One Grand Prize winner will be chosen, as well as one winner in each of the following categories:
Arts and Culture;
People and History;
Science and Nature;
Travel and Adventure.
Winners' names and photographs will be published in the February 2017 issue of Up Here magazine and will appear on Uphere.ca.
By submitting a photo to the contest the entrant hereby grants Up Here Publishing the right to use photos submitted to the contest (a) in the 2016 Up Here Photo Contest feature; and (b) in subsequent promotional material for the Up Here Photo Contest.
This includes both print and digital versions of the magazine, as well as online.
Up Here Publishing will also have rights to use images digitally to (c) further expand on the print edition; (d) promote Up Here magazine via Facebook, Twitter, Instagram and other social media outlets; and (e) archive issues of Up Here magazine.
Waiver forms/ model releases are the responsibility of the entrant.
With regard to any photograph submitted to this Contest, the owner of the photo’s copyright retains all copyright.
Up Here Publishing retains a world-wide, royalty-free, irrevocable and non-exclusive right and license to use, copy, adapt, transmit, communicate, publicly display and perform, distribute and create compilations and derivative works or merchandise from any winning photographs to promote the Contest.
The entrant agrees to represent and warrant that they have the right to grant the license set out above.
In the event copyright of any photograph submitted by an eligible entrant belongs to a person under 18 years of age, permission to enter the photo in the Contest, reprint, publish or otherwise reproduce the images, as described above, must be obtained, in writing from the child’s parent or guardian prior to entry of the photograph in the Contest. Proof of such permission must be provided to the Prize Provider immediately upon request.
Contest opens on July 13, 2016 and closes at 11:59 p.m. PST on November 30, 2016. All photographic entries must be uploaded prior to contest closing at 11:59 p.m. PST on November 30, 2016.
Entries submitted through fraudulent means or in any way tampered with, incorrect, unclear, forged, mutilated, illegible, indecipherable or mechanically reproduced may be disqualified at the sole discretion of Up Here Publishing and Nikon Canada Inc.
All Entries become the property of Up Here Publishing and will not be returned. Up Here Publishing and Nikon Canada Inc., are not responsible for entries lost, late, misdirected, illegible or delayed for any reason.
All photographs submitted to the Contest will be reviewed by the staff of Up Here magazine and the Contest winners will be selected by a panel of judges; including representatives of Up Here magazine and the photography community. Photographs will be assessed based on the following judging criteria: composition, content/originality, technical quality and visual impact.
Winners will be selected by a panel of judges prior to January 1, 2017.
Winners will be notified by email or telephone by 5:00 p.m. MST the week of January 9, 2017.
All decisions of the judging panel are final.
Up Here Publishing and Nikon Canada Inc. are not responsible for any failure of the website during the Contest. Nor is it responsible for any problems or technical malfunctions of computer online systems, servers, access providers, computer equipment, software or any e-mail, online or internet entry lost due to technical problems or traffic congestion on the internet or at any website or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the promotion.
Chances of Winning
The chances of winning a prize will depend on the total number of eligible photographs received and the evaluation of the photographs by the judging panel.
Winners will receive no compensation, credit or prizing other than as disclosed in these Rules or otherwise provided at the sole discretion of Up Here Publishing.
Prizes are not transferable; no prize substitutions, cash, or equivalents are permitted, except by Up Here Publishing at its sole discretion.
In all cases, Up Here Publishing reserves the right to substitute a prize of equal or lesser value for any of the Contest Prizes.
A single Grand Prize will be awarded to the entrant of the photo the judges deem is the best overall photo and can be selected from any of the four categories:
Arts and Culture;
People and History;
Science and Nature;
Travel and Adventure.
Grand Prize: a Nikon D7200 HD-SLR with AF-S DX NIKKOR 18-140mm f/3.5-5.6G ED VR.
Approximate value of Grand Prize: $1,799.95.
Allow six to eight weeks for delivery of the Grand Prize.
Category Prizes: A one-year subscription to Up Here magazine will be awarded to the best overall photo in each of the four photo entry categories. Approximate value of a one-year subscription to Up Here magazine: $34.95.
Prize Conditions (all prizes)
All prizes must be accepted as awarded and may not be used in conjunction with any other offer or promotion, sold, redeemed for cash, combined with any other promotion, and/or exchanged for a different prize.
By accepting a prize, the prize-winner agrees to hold Up Here Publishing and Nikon Canada Inc. and their respective agencies, affiliates, parent(s), subsidiaries, agents, advertising and promotion agencies and anyone else involved in the development, production or handling of the Contest and their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out acceptance or use of a prize.
Contest void where prohibited by law.
Up Here Publishing reserves the right to adjust these rules and regulations without prior notification.
By participating in the Contest, each Entrant agrees to be bound by the Up Here 2016 Photo Contest Rules and Regulations.
In the event of any and all disputes, a decision /decisions will be determined by Up Here Publishing. All decisions made by Up Here Publishing will be considered final.
